Particular attention is directed to requirements of Executive Order 11246, 11625 and 12138, as well as Section 3 requirements, as set forth in the Specifications.

The Pittsburgh Parks Conservancy, in partnership with the City of Pittsburgh, is accepting bids for the Allegheny Commons North Promenade Rehabilitation-Segment A Construction Project. No bidder may withdraw a submitted Proposal for a period of 75 days after the scheduled time for opening of the sealed bids.
A Pre-Bid Conference will be held on each of the above items at 10:00 am March 11, 2020 at Port Authority’s Heinz location (345 Sixth Avenue, Third Floor, Pittsburgh, PA). Attendance at this meeting is not mandatory, but is strongly encouraged. Questions regarding any of the above bids will not be entertained by the Port Authority within five (5) business days of the scheduled bid opening.
These contracts may be subject to a financial assistance contract between Port Authority of Allegheny County and the United States Department of Transportation. The Contractor will be required to comply with all applicable Equal Employment Opportunity laws and regulations.
Contractor is responsible for expenses related to acquiring a performance bond and insurance where applicable. All items are to be FOB delivered unless otherwise specified. Costs for delivery, bond, and insurance shall be included in bidder’s proposal pricing.
Port Authority of Allegheny County hereby notifies all bidders that it will affirmatively insure that in regard to any contract entered into pursuant to this advertisement, disadvantaged business enterprise will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

On or about Monday, March 23, 2020 the City of Pittsburgh will submit a request to the U.S. Department of Housing and Urban Development and the Pennsylvania Department of Community and Economic Development (DCED) for the release of the following funds:
Federal Neighborhood Stabilization Program (NSP) funds as authorized and appropriated under the Housing and Economic Recovery Act of 2008 (Public Law 110-289, July 30, 2008 as well as 2018 and 2019 CDBG Funds under Title 1 of the Housing and Community Development Act of 1974; HOME Funds under Title II of the Cranston-Gonzales National Affordability Housing Act of 1990, and HUD Upfront Grant Funds to undertake a project consisting of the Rehab for Resale of 35 abandoned/foreclosed properties and homeownership assistance in the form of soft second mortgages within the (5) approved targeted areas of the City of Pittsburgh, PA.
The proposed activity is Categorically Excluded from the National Environmental Policy Act requirements but are subject to compliance with the environmental laws and authorities listed at 58.5 of 24 CFR Part 58. In accordance with 58.15, the City of Pittsburgh will work in cooperation with the URA to conduct a Broad Tiered environmental review for the rehab/resale and soft 2nd mortgages for eligible units located in the (5) approved targeted areas of the City of Pittsburgh, which consist of: Northside, East End, Hill District, Hazelwood and Hilltop-South. A Tier 2 site specific review will be completed for those laws and authorities not addressed in the Tier 1 broad review for each address under this program when addresses become known. Tier 2 Site Specific Review: The site-specific reviews will cover the following laws and authorities not addressed in the Tier 1 broad review:
Airport Hazards, Flood Insurance, Contamination and Toxic Substances, Flood Plain Management, Historic Preservation, Noise Abatement Control and Environmental Justice.
An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Office of Management and Budget, 200 Ross St 2nd Floor, Pittsburgh Pa, 15219 and may be examined or copied weekdays from 8A.M to 4P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Pittsburgh Office of Management and Budget ATTN: Whitney Finnstrom Senior Manager, 200 Ross St, Suite 201 Pittsburgh, PA 15219. All comments received by the close of business on March 20, 2020 will be considered by the City of Pittsburgh prior to authorizing submission of a request for release of funds.
ENVIRONMENTAL CERTIFICATION
The City of Pittsburgh certifies to HUD and DCED that William Peduto, in his capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD and DCED approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Pittsburgh to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD and DCED will accept objections to its release of funds and the City of Pittsburgh’s certification for a period of fifteen days following its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the City approved by HUD; (b) the City of Pittsburgh has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD and DCED; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to:
