NOTICE OF ADDITIONAL PUBLIC NEEDS HEARINGS

CITY OF PITTSBURGH, PENNSYLVANIA

FISCAL YEAR 2022 ANNUAL ACTION PLAN

Notice is hereby given that the City of Pittsburgh is currently preparing its FY 2022 Annual Action Plan (April 1, 2022-March 31, 2023). The City will apply for the following Federal funds: Community Development Block Grant (CDBG), Home Investment Partnerships (HOME), Emergency Solutions Grants (ESG), and Housing Opportunities for Persons With AIDS (HOPWA) from the U.S. Department of Housing and Urban Development (HUD).

The City will hold public needs hearings at the times and locations noted below. The hearings are being held at various locations to provide all City residents with ample opportunity to attend and comment. Interested

persons only need to attend one of the public hearings at the most convenient location.

The purpose of this condemnation is to acquire certain property, designated in the Allegheny County Department of Real Estate as 236-K-158, needed for the reconstruction of the Kenmawr Avenue Ramp Bridge (MA07-KN04), in Rankin Borough, Allegheny County, Commonwealth of Pennsylvania.

Statement of Condemnation. Condemnee’s property identified on the Viewers’ Plan marked as Exhibit B to the Declaration of Taking, attached hereof, has been condemned as of March 29, 2022. The title acquired by the County is a temporary easement interest, in the area labeled “Temporary Construction Easement” on Exhibit B. Plans showing the property condemned may be inspected in Condemnor’s offices noted above and are also lodged of record in the Allegheny County Department of Real Estate, at State Highway Plan Volume 188 at age 60. Just compensation for the condemnation is secured by the County’s power of taxation, which is deemed pledged as security for the payment of damages as, shall be determined by law.

Challenging the Condemnation. If Condemnee wishes to challenge the power or the right of County to appropriate the condemned property, the sufficiency of the security, the procedures followed by County or the Declaration of Taking, the Condemnee must file preliminary objections within 30 days after being served with Notice of Condemnation.

The purpose of this condemnation is to acquire certain property that has not been designated as a tax parcel but is located on the westerly side of Thompson Run Road approximately 650’ north of the Thompson Run Road and Babcock Boulevard intersection, needed for the replacement of the Thompson Run Road Culverts No. 2 and Culvert No. 3, in Ross Township, Allegheny County, Commonwealth of Pennsylvania.

Statement of Condemnation. Condemnee’s property identified on the Viewers’ Plan marked as Exhibit B to the Declaration of Taking, attached hereof, has been condemned as of March 29, 2022. The title acquired by the County is a fee simple required right-of-way interest, in the area labeled “Required Right-of-Way” on Exhibit B. Plans showing the property condemned may be inspected in Condemnor’s offices noted above and are also lodged of record in the Allegheny County Department of Real Estate, at State Highway Plan Volume 189 at age 7. Just compensation for the condemnation is secured by the County’s power of taxation, which is deemed pledged as security for the payment of damages as, shall be determined by law.

Statement of Condemnation. Condemnee’s property identified on the Viewers’ Plan marked as Exhibit B to the Declaration of Taking, attached hereof, has been condemned as of March 29, 2022. The title acquired by the County is a fee simple interest, including all interests of every record owner thereof or any party claiming an interest therein, in the area labeled “Required Right-of Way” and an easement interest in the area labeled “Temporary Construction Easement” on Exhibit B. Plans showing the property condemned may be inspected in Condemnor’s offices noted above and are also lodged of record in the Allegheny County Department of Real Estate, at Plans-Miscellaneous, Book 190, Page 7. NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

This notice shall serve to correct information provided on March 16, 2022 for the combined Notice of Finding of No Significant Impact and Notice of Intent to Request Release of Funds

The prior notice stated “All comments received by Sunday, April 3, 2022 will be considered by the City of Pittsburgh prior to authorizing submission of a request for release of funds.” In order to comply with HUD policy, the sentence should read, “All comments received by Thursday, April 7, 2022 will be considered by the City of Pittsburgh prior to authorizing submission of a request for release of funds.”

The prior notice also stated, “On or about Monday, April 4, 2022, the City of Pittsburgh will submit a request to the U.S. Department of Housing and Urban Development (HUD) to release Federal funds under Title 1 of the Housing and Community Development Act of 1974 as amended for the real estate project described below.” In order to comply with HUD policy, the sentence should read, “On or about Friday, April 8, 2022, the City of Pittsburgh will submit a request to the U.S. Department of Housing and Urban Development (HUD) to release Federal funds under Title 1 of the Housing and Community Development Act of 1974 as amended for the real estate project described below.”

The prior notice also stated, “Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to the HUD Field Office of Public Housing in Pittsburgh at PittsburghPIH.ER@hud.gov.” In addition, the notice should also have included the email address for objections to the HUD Field Office in Pittsburgh,

Phillip.E.McKeough@hud.gov.
