Inside Conditions…Aerial assault

Ladies and gentlemen let me begin this communiqué by pointing out that I am not an attorney-at-law, nevertheless I may occasionally receive a casting call to portray one on television. Just kidding folks but you will get my point in a few moments.
Let’s put our “noggins” together and discuss the legal definition of the word assault. For the sake of space I can only provide a partial definition of the word here.
The website; thefreedictionary.com defines assault as: “an intentional act by one person that creates an apprehension in another of an imminent harmful or offensive contact. An assault is carried out by a threat of bodily harm coupled with an apparent, present ability to cause the harm. It is both a crime and a TORT and, therefore, may result in either criminal or civil liability.”
Last Saturday as I sat by the “telly” and watched the Pittsburgh Pirates, Arizona Diamondbacks “basebrawl” game I began to wonder not if but when a Pittsburgh player would be hit by an Arizona pitcher in retaliation for Pirates reliever Ernesto Frieri hitting Diamondbacks star Paul Goldschmidt in the left hand with a “smoker” the night before causing a fracture that according to the Diamondbacks manager Kirk Gibson has ended Goldschmidt’s season. “Realistically, it’s eight weeks, so he’s done.”
